What does everyone think of the Return to Seller Clause ? I(John) do not like it. I think if you buy anything and you want to sell it down the line you should be able to. You shouldn't just have to give it back to the person you purchased from. I think a buy back policy would be more appropriate.

I am totally in favor of a return to seller clause. All my chins go with that in the contract.

I am also in favor of it. I think that in SOME circumstances I would be willing to change it.

Under the circumsance of a person just not wanting it anymore, most people who really care for just the welfare of the animal are more than willing to give it back to the breeder.

As for a breeder buying a chin then later wanting to sell it due to space or expanding lines, I feel they should contact the original breeder FIRST and offer them buyback.

I think it depends on why the animal is leaving the current home... was it a pet? was it a breeder? I take all of this into consideration..

I want to be the first person to know if my chinchilla is needing to be sold. If that means buying it back, I will do that. HOWEVER, I don't want my chins going to strange places or for people to start brokering them. They are MY babies and I trust people with them. The least they can do is offer my chinchilla back to me should they decide to sell it.

I will always have a clause that I must be contacted first. That will NEVER, EVER change. I don't care what chinchilla it is, I want to know that someone is selling him or her....And, I want to be able to buy/be given my baby back!!!

You have to let me know if you decide to get rid of Luna. I want that chin back if you do.

Luna is my girl, and I am very thankful of you for her. John and I would never consider selling her, b/c she has a forever home :heart:. When we get our own place we want you to come over to see what a spoiled chinnie she is. She is also the smartest chin we have, and a real beauty.

John is curious b/c we want to expand our "herd" and have come across this clause with a few breeders. His take on it is that the clause basically means that the chin never leaves the breeder's ownership. You would have to return the chin to the seller for free. Hearing all of yours answers makes the return to seller clause look more like a buy back policy and a means of notifing you?, which I find very reasonable and understanding.

At the point where someone needs to find a new home for a chin, that's their chinchilla and they do have a right to ask for money back, of course!

Sometimes I wouldn't consider paying for my chin back. In the situation where the chinchilla is sick or injured, I wouldn't give those people a penny...but then again, neither would anyone else. Most of the time when someone has to find a home for their chin, they are willing to give it back without getting paid for it. It's usually a desperate situation at that point.

I really just want to see where my babies are going. If it comes down to it, I really want to talk to the new people where the chins are going to end up. They need to be feeding the right things and caring for the chins properly.

I agree with Susan. It's important for me to know where my babies go. I don't mind buying back the chin if its happy and healthy.

My biggest thing is I want first right of refusal, and if I can't take it I want to have some input on where the chin goes.

I agree that a buy back policy is better than a return to seller policy. With a return to seller, there is very little chance they are just going to give it back if they know they can get money for it from someone else. At least with Buy Back, they understand they can get their money back and may not even have to worry about pushing a sale with someone else.

With my buy back policy, it is written that the breeder has first right of refusal to buy the chin back for the original purchase price. You really do have to stipulate that because I've seen people offer to sell back to the original breeder and then jack the price up. That's just SOO not cool

I just want to talk to the people that are getting my chins. It isn't about money, it isn't about control, it's about where my little babies are ending up. I like to approve new homes and make sure that they know what to do. A lot of times someone at someone's work or school says, "Sure, I'll take your chin..no problem!" Then that person ends up starving the chins to death or not keep them clean enough.

Now, if a person is getting rid of the chins they bought from me, I may as well be the person that gets them back! I'll give people money back for their chins, they tell me what they want and I give it to them. If it's been like four years and the chins are malnourished, I may not be wanting to give them back all the money...but if it's the only way to get them back, I will do it...begrudgingly. :)

I agree with the seller clause as well. That is the agreement I really prefer when buying or selling chins because I know that if I would have to let the breeder have them, they will be well taken care of and I would want my babies to come back to me if the buyer could no longer keep them either. :)
